Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Dystro website, API, dashboard, and related services (the "Service"), provided by Bamboo Bay, Lda. ("Dystro", "we", "us"). By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

1. The Service

Dystro is a unified social API that lets you connect social media accounts and publish, schedule, manage, and analyze content across those networks through a single interface. Features and supported platforms may change over time.

2. Accounts & eligibility

You must be at least 16 years old and able to form a binding contract. You are responsible for your account credentials, API keys, and all activity under your account. Notify us promptly of any unauthorized use at security@dystro.dev.

3. Connected platforms

The Service integrates with third-party platforms (such as X, Meta, TikTok, LinkedIn, YouTube, Reddit, Pinterest, Snap, Bluesky, and Google Business). Your use of those platforms through Dystro is also subject to their terms and policies. You are responsible for complying with each platform's terms, and for maintaining any rights and permissions needed for the content you publish. We are not responsible for third-party platforms, including changes, outages, rate limits, or account actions they take.

4. Acceptable use

You agree not to use the Service to:

  • send spam, or post deceptive, unlawful, infringing, or harmful content;
  • violate any platform's terms, rate limits, or automation policies;
  • infringe intellectual-property or privacy rights;
  • reverse engineer, resell, or circumvent access controls or usage limits of the Service; or
  • interfere with the security or integrity of the Service.

We may suspend or limit access to protect the Service, our users, or third-party platforms.

5. Your content

You retain all rights to the content you submit or publish through the Service. You grant us a limited license to host, process, transmit, transcode, and display that content solely to operate the Service and carry out your instructions. You are solely responsible for your content and for having the necessary rights to it.

6. API usage

Access to the API is subject to the scopes, quotas, and rate limits associated with your plan. We may adjust limits to protect reliability. You must keep API keys confidential and rotate them if compromised.

7. Fees

Paid plans are billed as described at the time of purchase, through our payment processor. Fees are non-refundable except as required by law or expressly stated. We may change pricing prospectively with notice.

8. Intellectual property

The Service, including its software, design, and trademarks, is owned by Dystro and its licensors and is protected by law. These Terms grant you no rights to our marks or software except the limited right to use the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that third-party platforms will remain available or compatible.

10. Limitation of liability

To the maximum extent permitted by law, Dystro will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability for any claim arising out of or relating to the Service is limited to the amounts you paid us for the Service in the twelve months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Dystro from claims, damages, and expenses arising out of your content, your use of the Service, or your violation of these Terms or any third-party platform's terms.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or if required to protect the Service or comply with law. On termination, your right to use the Service ends and we will delete or return your data as described in our Privacy Policy and Data Deletion policy.

13. Governing law & disputes

These Terms are governed by the laws of Portugal, without regard to conflict-of-laws rules. The courts of Faro, Portugal will have exclusive jurisdiction, unless mandatory local law provides otherwise.

14. Changes to these Terms

We may update these Terms from time to time. We will post the revised version here with a new effective date and, for material changes, provide additional notice. Continued use after changes take effect constitutes acceptance.
